Terms of Service

PointWake provides workflow consulting, CRM setup and management, automation builds, AI phone and messaging systems, marketing services, and training. The exact scope of any engagement is set out in the written proposal, quote, or service plan you approve before work begins. Anything not listed in that document is out of scope until both sides agree to it in writing.

We do not promise specific revenue, lead volume, ranking, or conversion results. Outcomes depend on your market, your offer, your pricing, and how your team uses what we build.

Ongoing plans, including Managed CRM Support, are billed month-to-month in advance. Billing starts on the day your plan is activated and renews on the same day each month until you cancel.

Setup fees and build-out projects are quoted per project and are separate from any monthly plan fee. Project fees are due as stated in your quote, and work begins after the first payment is received.

Third-party costs are your responsibility and are not included in our fees. That includes software subscriptions, phone and messaging usage, email sending charges, and advertising spend paid directly to the ad platform.

Payments that fail or remain unpaid may result in services being paused until the balance is settled.

Monthly plans can be cancelled at any time with written notice to info@pointwake.com before your next renewal date. Cancellation takes effect at the end of the current paid month. We do not prorate or refund partial months, and fees already paid for completed work are non-refundable.

We may end an engagement with written notice if the relationship becomes unworkable, if payment is overdue, or if we are asked to do something unlawful or against a platform's terms.

You own your GoHighLevel account, your customer records, your contact lists, your conversation history, and any other business data in your systems. That is true during the engagement and after it ends. We access those systems only to deliver the services you have asked for.

If you cancel, we will hand over administrative control of your account and will not delete or hold your data hostage. You are responsible for keeping your own backups and for maintaining the subscriptions those systems run on.

PointWake retains ownership of its own templates, internal frameworks, documentation, and reusable tooling. You receive a perpetual license to use the configurations and assets we build inside your account for your own business.

You agree to provide accurate information, timely access to the accounts we need, and timely feedback and approvals. You are responsible for how you communicate with your own customers, including compliance with laws that apply to calls, texts, and email marketing, and for obtaining any consent those laws require.

To the fullest extent allowed by law, PointWake is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to our services.

Our total liability for any claim is limited to the amount you paid PointWake for the services in the three months immediately before the event giving rise to the claim.

We are not responsible for outages, changes, price increases, or data loss caused by third-party platforms, including GoHighLevel, phone and messaging carriers, email providers, search engines, and advertising networks.

Each side agrees to keep the other side's non-public business information confidential and to use it only for the purpose of delivering or receiving the services.

We may update these terms from time to time. The version posted on this page is the version that applies. Material changes to an active engagement will be communicated to you directly.

These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Comal County, Texas.
